ORDINANCE NO. 2023-44 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS CREATING A FOUR-HOUR PARKING RESTRICTION BETWEEN THE HOURS OF 8:00 A.M. AND 5:00 P.M. MONDAY THROUGH FRIDAY IN THE GENERAL AREA OF DOWNTOWN SAN MARCOS AS AUTHORIZED BY SECTION 82.160 OF THE SAN MARCOS CITY CODE AND AMENDING THE TRAFFIC REGISTER TO REFLECT SUCH PARKING RESTRICTIONS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE. RECITALS: 1. Section 82.160 of the San Marcos City Code allows the placement of signs on public streets or in a public area giving notice that parking is limited to a specified time. 2. The designation of a four-hour parking zone in the general area of downtown is in the interest of the public health, safety and welfare. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. A four-hour parking zone, as recommended and attached in Exhibit A, to be in effect between the hours of 8:00 a.m. and 5:00 p.m. Monday through Friday, is hereby designated on both sides of the following streets and roadways: between the 300 and 400 blocks of East San Antonio Street between Edward Gary Street and CM Allen Parkway; between the 100 and 200 blocks of North Edward Gary Street between LBJ Drive and Hopkins Street; between the 100 and 200 blocks of South Edward Gary Street between LBJ Drive and Hopkins Street; between the 100 and 200 blocks of Martin Luther King Drive between Alley and Guadalupe Street; between the 300 and 400 blocks of West San Antonio Street between Comanche Street and Harvey Street; and between the 400 and 500 blocks of West San Antonio Street between Harvey Street and North Street. SECTION 2. The four-hour parking zone established under Section 1 does not apply to designated loading zones or residential permit areas established by previous ordinances. SECTION 3. The Traffic Register maintained under Section 82.067 of the San Marcos City Code is amended to reflect the four-hour parking designation established under Section 1. SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. This ordinance shall be in effect upon adoption on second reading.
