ORDINANCE NO. 2023-44 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS CREATING A FOUR-HOUR PARKING <br /> RESTRICTION BETWEEN THE HOURS OF 8:00 A.M. AND 5:00 P.M. <br /> MONDAY THROUGH FRIDAY IN THE GENERAL AREA OF <br /> DOWNTOWN SAN MARCOS AS AUTHORIZED BY SECTION 82.160 OF <br /> THE SAN MARCOS CITY CODE AND AMENDING THE TRAFFIC <br /> REGISTER TO REFLECT SUCH PARKING RESTRICTIONS; <br /> INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Section 82.160 of the San Marcos City Code allows the placement of signs on <br /> public streets or in a public area giving notice that parking is limited to a specified time. <br /> 2. The designation of a four-hour parking zone in the general area of downtown is in <br /> the interest of the public health, safety and welfare. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. A four-hour parking zone, as recommended and attached in Exhibit A, to <br /> be in effect between the hours of 8:00 a.m. and 5:00 p.m. Monday through Friday, is hereby <br /> designated on both sides of the following streets and roadways: between the 300 and 400 blocks <br /> of East San Antonio Street between Edward Gary Street and CM Allen Parkway; between the <br /> 100 and 200 blocks of North Edward Gary Street between LBJ Drive and Hopkins Street; <br /> between the 100 and 200 blocks of South Edward Gary Street between LBJ Drive and Hopkins <br /> Street; between the 100 and 200 blocks of Martin Luther King Drive between Alley and <br /> Guadalupe Street; between the 300 and 400 blocks of West San Antonio Street between <br /> Comanche Street and Harvey Street; and between the 400 and 500 blocks of West San Antonio <br /> Street between Harvey Street and North Street. <br /> SECTION 2. The four-hour parking zone established under Section 1 does not apply to <br /> designated loading zones or residential permit areas established by previous ordinances. <br /> SECTION 3. The Traffic Register maintained under Section 82.067 of the San Marcos <br /> City Code is amended to reflect the four-hour parking designation established under Section 1. <br /> SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br /> held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br /> this ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 6. This ordinance shall be in effect upon adoption on second reading. <br />
