2023-2026 Meet and Confer Agreement <br />Between the San Marcos Professional Firefighters Association and the City of San Marcos, Texas <br />hiring process, the Fire Chief will meet with the background investigator to confirm that the applicant meets the <br />criteria to take advantage of this program. <br />A. Eligibility Requirements - Applicants must: <br />1. Be dual certified: Firefighter (TCFP) and EMT Basic (or higher) (National Registry or DSHS Certification). <br />2. Have at least one (1) year prior full-time work experience with similar duties in a comparable fire and/or <br />EMS agency; one year of experience will qualify for advancing one step to a maximum of 8 steps (Step <br />19.08). <br />3. Must not have had a break in service as a Firefighter and/or EMT Basic (or higher) of more than 180 days <br />prior to the applicant's conditional job offer. <br />B. Guidelines: <br />1. The lateral entry program is for pay purposes only and actual work experience in another fire and/or <br />EMS Agency will not be considered for promotional eligibility requirements. <br />2. The Fire Chief's determination, following review with the Association President, of whether an applicant <br />meets the criteria of the lateral entry program shall be final and non -appealable to the Civil Service <br />Commission or to any court. <br />3. If an applicant is placed up above the minimum starting, up to step 19.08 of the pay schedules, they will <br />progress through the remaining steps as they complete each year of service. <br />4. Longevity pay will be calculated in the same manner as all Firefighters. No credit will be given to <br />completed years of service in other agencies. <br />5. Entry-level firefighters placed up to Step 19.08 of the pay schedule, as per the lateral entry program, <br />must also complete a new hire probationary period. <br />C. Non -classified firefighter: <br />The chief may appoint part-time firefighters, for limited purposes, excluding assignments to operations, <br />which will not be members of the classified service at appointment and will not have the protections of civil <br />service at employment or for the duration of employment Part-time firefighters shall not work more than <br />1,000 hours per year and not more than 30 hours in any week unless approved by the Director of Human <br />Resources, or their designee, in writing. <br />D. Statutory Preemption: <br />To the extent that any of these provisions are in conflict with the TLGC Chapter 141, 142 and 143, this <br />provision shall prevail. <br />Section 3. Eligibility List: <br />A. This article shall supersede Section 143.025 of the Texas Local Government Code to allow for more than one <br />eligibility list to be in effect at the same time which shall be utilized upon the exhaustion or expiration of the <br />prior list. <br />B. Additional points may be awarded only to an applicant for a beginning position with a passing score of 70 as <br />follows: <br />Page 4 <br />
