SOLUTION NO. 2023-135R <br /> A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF SAN <br /> RCOS, TEXAS APPROVING A REQUEST BY L,IA ENGINEERING <br /> ON BEHALF OF ONX-HIGH BRANCH, LLC, ASSIGNED CASE NO. <br /> AC23-04 (TILE RIDGE AT HIGH BRANCH PHASE 2 AND 3), FOR AN <br /> ALTERNATIVE COMPLIANCE TO THE MAXIMUM CUT AND FILL IN <br /> SECTION 6.1.2.2 OF THE LAND DEVELOPMENT CODE FOR A <br /> PROPOSED RESIDENTIAL SUBDIVISION GENERALLY LOCATED <br /> NEAR REDWOOD ROAD BETWEEN STATE HIGHWAY 123 AND OLD <br /> BASTROP HIGHWAY; AUTHORIZING CITY STAFF TO ISSUE <br /> PERMITS CONSISTENT WITH THIS SOLUTION; AND DECLARING <br /> AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The request by LJA Engineering on behalf of ONX-High Branch, LLC, <br /> assigned Case No. AC-23-04 (The Ridge at High Branch Phase 2 and 3), for an Alternative <br /> Compliance to the maximum cut and fill in Section 6.1.2.2 of the Land Development Code for a <br /> proposed residential subdivision generally located near Redwood Road between Highway 123 and <br /> Old Bastrop Highway (the "Project"), to increase the maximum cut to 22 feet and the maximum <br /> fill to 18 feet as more specifically shown on the Cut and Fill Exhibit attached hereto and made a <br /> part hereof as Exhibit A, is hereby approved, subject to any conditions as are also stated in Exhibit <br /> A. <br /> PART 2. City staff is hereby authorized to issue permits related to the construction of <br /> the Project consistent with any Alternative Compliance approved by this resolution, subject to <br /> compliance with other applicable laws and ordinances. <br /> PART 3.
