RESOLUTION NO. 2023-123R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN AGREEMENT FOR THE PROVISION OF SERVICES IN CONNECTION WITH THE PROPOSED OWNER REQUESTED ANNEXATION IN CASE NO. AN-23-09 OF AN PROXIMATELY 1.8 ACRE TRACT OF LAND OUT OF THE ANDREW MITCHELL SURVEY IN GUADALUPE COUNTY AND THE CHARLES HENDERSON SURVEY IN HAYS COUNTY, TEXAS, GENERALLY LOCATED EAST OF THE INTERSECTION BETWEEN LOVELADY LANE AND STATE HIGHWAY 1239 AUTHORIZING THE CITY MANAGER,OR HER DESIGNEE,TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY; SETTING A DATE FOR A PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION OF SAID TRACT OF LAND, AND DECLARING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Agreement for the Provision of Services in connection with the proposed annexation in case number AN-23-09 of an approximately 1.8 acre tract of land, out of the Andrew Mitchell Survey in Guadalupe County and the Charles Henderson Survey in Hays County, Texas, generally located east of the intersection between Lovelady Lane and SH-123, is hereby approved. PART 2. The City Manager, or her designee, is authorized to execute said agreement on behalf of the City. PART 3. The date for the public hearing concerning the proposed annexation of the land described in said agreement shall be September 5, 2023. PART 4.
