RESOLUTION NO. 2023-134R <br /> A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS,TEXAS OBJECTING TOT E INCLUSION OF ANY PORTION <br /> OF THE CITY LIMITS OF THE CITY IN THE PROPOSED CALDWELL <br /> COUNTY EMERGENCY SERVICES DISTRICT NO. 5; CONSENTING TO <br /> THE INCLUSION OF TERRITORY WITHIN THE CITY'S <br /> EXTRATERRITORIAL JURISDICTION IN SUCH PROPOSED <br /> EMERGENCY SERVICES DISTRICT; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On June 20, 2023, the City received a petition for creation of Caldwell County <br /> Emergency Services District No. 5 to include both the city limits of the City and territory within <br /> the City's extraterritorial jurisdiction. <br /> 2. According to Section 775.014 of the Texas Health and Safety Code,the governing <br /> body of the City must act on the request within 60 days of the request,or the request will be deemed <br /> denied. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The San Marcos City Council hereby opposes the inclusion of any territory <br /> within the city limits of the City of San Marcos, Texas in the proposed Caldwell County <br /> Emergency Services District No. 5. <br /> PART 2. The San Marcos City Council hereby consents to the inclusion of territory <br /> within the extraterritorial jurisdiction of the City of San Marcos, Texas in the proposed Caldwell <br /> County Emergency Services District No. 5. <br /> PART 3.
