(g) Enforcement actions taken under this section are not exclusive, and <br /> do not affect any other remedies for violations of section 14.371 or 14.372. <br /> (h) Maintenance registration can be revoked upon charge or conviction <br /> of any code violation. <br /> (i) A person is subject to disciplinary action under this section if the <br /> person violates an order issued by the Board, a board rule, or any of the following: <br /> (1) Obtaining an lieense, endorsement or registration through error or <br /> fraud; <br /> (2) Willfully, negligently, or arbitrarily violating a municipal rule or <br /> ordinance that regulates sanitation, drainage, or plumbing; <br /> (3) Making a misrepresentation of services provided or to be provided <br /> to a customer that causes financial harm to the customer; or <br /> (4) Making a false promise with the intent to induce a person to contract <br /> for a service, <br /> (k) Retesting pr-oeedufes may be used to detefmine w-hethef grounds <br /> exist f6f sus,'-...—. — —Veeation of a lieense, endefsemetA, or-Fegistration due to <br /> ineempetenee or-a willful violation by a per-son lieensed under this ehaptef. <br /> Sec. 14.380. Hearing procedures for revocation of registration se; notice of <br /> revocation. <br /> (a) When the Construction Board of Appeals is notified that a <br /> registree's,lieensee's license or-registration has been suspended twice in a three-year <br /> period under subsection 14.380(a), and that the registreelieensee has committed <br /> another violation under section 14.371 or 14.372, the Board will set a registration <br /> revocation hearing within thirty (30) days and will send a copy of the information <br /> to the registree by certified mail or by hand delivery not less than ten (10) days <br /> before the date of the hearing. <br /> (b) The registreelieensee may appear in person at the hearing and may <br /> be represented by an attorney or any other person. All hearings will be open to the <br /> public. The City and the registreelieensee are entitled to present evidence and <br /> arguments at the hearing. The Board may,through its chair or secretary,administer <br /> oaths and compel the attendance of witnesses by subpoena issued by the chair. If <br /> the registreelieensee does not appear,the Board may proceed to hear and determine <br /> whether to revoke the registreelieenseels license. <br /> (c) If the registreeliee*s-ee admits the truth of the charges, or if the <br /> Board, by vote of three (3) or more members, finds them to be true,the Board will <br />
