RESOLUTION NO. 2023-142R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING A RELEASE OF EASEMENT AND <br /> QUITCLAIM DEED OF CITY PROPERTY LOCATED SOUTHWEST <br /> OF POSEY ROAD BETWEEN IH-35 AND SPINY LIZARD LANE <br /> UNDER THE TERMS OF AN EASEMENT EXCHANGE AGREEMENT <br /> WITH JMC REALTY L.P., A TEXAS LIMITED PARTNERSHIP; <br /> AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, <br /> TO EXECUTE DOCUMENTS PURSUANT TO THIS AGREEMENT <br /> ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Easement Exchange Agreement (Agreement) with JMC <br /> Realty L.P., a Texas Limited Partnership, (JMC) is hereby approved, subject to replacement <br /> easements approved by the Director of Engineering and Capital Improvements being dedicated to <br /> the City by JMC. <br /> PART 2. The City Manager, or her designee, is authorized to execute said <br /> Agreement, and the associated Release of Easement and Quitclaim Deed, on behalf of the City. <br /> PART 3.
