ORDINANCE NO. 2023-68 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AUTHORIZING THE INSTALLATION OF SPEED <br /> CUSHIONS IN BOTH DIRECTIONS IN THE 200 THROUGH 400 BLOCKS <br /> OF HORACE HOWARD DRIVE (FROM APPROXIMATELY 670 FEET <br /> WEST OF OLD BASTROP HIGHWAY TO DACHSUND DRIVE); <br /> INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AND <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Horace Howard Drive is a two-lane collector street characterized by single-family <br /> residential developments. <br /> 2. Residents have submitted a request for the installation of speed cushions on Horace <br /> Howard Drive. <br /> 3. A traffic study was conducted indicating an average daily traffic count of 148 vehicles <br /> and an 85th percentile speed on Horace Howard Drive of 39.5 miles per hour between Old Bastrop <br /> Highway and Dachsund Drive. <br /> 4. These traffic conditions are unsafe and warrant the installation of speed cushions. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Recitals are hereby found to be true and correct and are adopted as the <br /> findings of the City Council. <br /> SECTION 2. Pursuant to Section 82.066 of the San Marcos Code, on the basis of such <br /> findings,the City Council hereby authorizes the installation of speed cushions in both directions in <br /> the 200 through 400 blocks of Horace Howard Drive (from approximately 670 feet west of Old <br /> Bastrop Highway to Dachsund Drive). <br /> SECTION 3. The installation of signs providing notice of the presence of the speed <br /> cushions is also hereby authorized. <br /> SECTION 4. If any word,phrase,clause,sentence,or paragraph of this ordinance is held to <br /> be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br /> with this ordinance are repealed. <br />
