ORDINANCE NO. 2023-66 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE RATES FOR THE CLEAN <br /> COMMUNITY FEE, KNOWN AS THE COMMUNITY ENHANCEMENT <br /> FEE, IN ACCORDANCE WITH SECTION 66.002 OF THE SAN MARCOS <br /> CODE OF ORDINANCES; INCLUDING PROCEDURAL PROVISIONS; <br /> AND DECLARING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. In accordance with Section 66.002 of the San Marcos Code of Ordinances,the <br /> monthly rates charged for the Clean Community Fee, known as the Community Enhancement Fee, <br /> are amended in accordance with Exhibit A, which is attached hereto and incorporated for all <br /> purposes. <br /> SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br /> with this ordinance are repealed. <br /> SECTION 3. If any word,phrase, clause, sentence, or paragraph of this ordinance is held <br /> to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in full force if they can be given effect without the invalid provision. <br /> SECTION 4.
