ORDINANCE NO. 2023-75 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE 2023 ANNUAL SERVICE PLAN <br /> UPDATE FOR THE WHISPER SOUTH PUBLIC IMPROVEMENT <br /> DISTRICT; AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, <br /> TO EXECUTE SAID DOCUMENT ON BEHALF OF THE CITY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council of the City of San Marcos ("City Council") adopted Resolution <br /> 2021-91R creating the Whisper South Public Improvement District on May 4, 2021; <br /> 2. The City Council adopted Ordinance 2021-97 approving a Financing Agreement <br /> relating to the Whisper Public Improvement District on December 15, 2021; <br /> 3. The City Council adopted Ordinance 2021-95 approving the original Service and <br /> Assessment Plan and special assessments on December 15, 2021; and <br /> 4. The City Council's last update for the Service and Assessment Plan was approved <br /> on October 3, 2022. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached 2023 Annual Service Plan Update for the Whisper South <br /> Public Improvement District(the "Service Plan Update") is hereby approved. <br /> PART 2. The City Manager, or her designee, is authorized to execute the Service Plan <br /> Update on behalf of the City. <br /> PART 3.
