ORDINANCE NO. 2023-74 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE 2023 ANNUAL SERVICE PLAN <br /> UPDATE FOR THE WHISPER PUBLIC IMPROVEMENT DISTRICT; <br /> AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO <br /> EXECUTE SAID DOCUMENT ON BEHALF OF THE CITY; AND <br /> DECLARING AN EFFECTIVE, DATE. <br /> RECITALS: <br /> 1. The City Council of the City of San Marcos ("City Council") adopted Resolution <br /> No. 2014-143R creating the Whisper Public Improvement District on October 6, 2014; <br /> 2. The City Council adopted Resolution No. 2017-139R approving a Financing <br /> Agreement relating to the Whisper Public Improvement District on September 5,2017; <br /> 3. The City Council adopted Ordinance No. 2020-37 approving a special assessment <br /> on June 2, 2020; and <br /> 4. The City Council's last update for the Service and Assessment Plan was approved <br /> on October 3,2022. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached 2023 Annual Service Plan Update for the Whisper Public <br /> Improvement District(the "Service Plan Update") is hereby approved. <br /> PART 2. The City Manager, or her designee, is authorized to execute the Service Plan <br /> Update on behalf of the City. <br /> PART 3.
