ORDINANCE NO. 2023-82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 14 OF THE SAN MARCOS CITY CODE, BY ADDING A NEW ARTICLE 4 THAT ADOPTS LOCAL AMENDMENTS TO THE INTERNATIONAL PROPERTY MAINTENANCE CODE REQUIRING ARTISTIC BOARDING UP OF VACANT STRUCTURES; PROVIDING FOR THE REPEAL OF CONFLICTING PROVISIONS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 14 of San Marcos City Code is hereby amended by adding a new Article 4 as set forth below. Added text is indicated by underlining. Deleted text is indicated by strikethroughs. ARTICLE 4. RESERATDPROPERTY MAINTENANCE CODE. Section 14.061. Amendments. (a) The International Property Maintenance Code adopted by section 14.002 is amended to add local requirements as set out below. (1) Section 202's General Definitions are amended to also include: ��raised value means the value given the structure by the applicable county's tax assessor's office. Artistic boarding means painting material used to secure door, window, or other openings to resemble the opening which they are covering. Refer to standards for securing and artistic board -up. Building means any structure of any kind or any part thereof, including a wall slab porch foundation, the collapsed remains of a structure or any other portion of a building, wall, or fence that was erected for the supportshelter or enclosure of persons, animals, chattel or property of an kind. ind. City means the City of San Marcos, Texas. Citv council means the Citv Council of the City of San Marcos. Diligent effort means best or reasonable effort to determine the identity and address of an owner, a lien holder, or a mortgagee including a search of the following records: 1. County real property records of the county in which the building is located. 2. Appraisal district records of the appraisal district in which the building is located.
