<br /> 36 <br />Regular Meeting January 14, 1991 Page 5 <br />Mayor Morris intorduced for consideration an addendum, the City <br />Manager's Report. (1) Mr. Gilley provided an update on students' <br />request for a skateboard park. Mr. Gilley stated the City checked <br />with our liability carrier who indicated the City would have <br />significant exposure, but that coverage could be possible if the <br />City complied with active supervision, fencing of the park and <br />coverage at a cost of $7,500 annually. Mr. Gilley stated the <br />expense is excessive and Staff recommends the City not participate <br />in such a program. It was suggested that if the students could find <br />a means to raise the funds for the needed insurance coverage to <br />offset the City's liability, this program could be considered. (2) <br />The Parks and Recreation Staff have a plan to operate a Teen Center <br />one weekend per month on a trial basis, and a meeting is planned <br />next week to present the plan to the students. (3) On January 21, <br />1991 at 7:00 p.m. a meeting will be held in the Council Chambers by <br />SMEU to look at options for operating the management of SMEU. SMEU <br />is gathering recommendations to bring to the Council. (4) The <br />contractor for the Thorpe Lane Paving and Drainage Project has not <br />received final paYment yet. The Staff is trying to work out issues <br />with the contractor, and the work that has been completed does meet <br />our specifications. (5) No time has yet been set for the <br />construction to begin for the Loop 82 project. The City has not yet <br />received the license agreement needed from Union Pacific, and Union <br />Pacific wants to address the Council. (6) Mayor Morris asked for a <br />list of the surplus City property. Mr. Gilley can provide a listing <br />of City property for the Council to review by legal description but <br />does not have the property listed by street address. (7) Mayor <br />Morris asked for the street name policy to come to the Council at <br />the next meeting if possible. <br />Mayor Morris introduced for consideration an addendum, the City <br />Attorney's Report. Mr. Taylor sta~ed the Council has asked for <br />information regarding the City's right to regulate local cable <br />rates. The Federal Cable Commission is looking into giving back <br />some authority to Cities, but it does not appear it will happen in <br />the near future. <br />Mayor Morris introduced for consideration an addendum, the City <br />Council's Report. (1) Mayor Morris reminded the Council Members <br />who are Members of the Corridor Council that the Monterrey, Mexico <br />meeting is in the near future. (2) Mayor Morris asked if. the <br />Council was interested in an Ordinance pertaining to solicitation to <br />buy drugs, and requested Mr. Taylor look into this possibility. <br />Mayor Morris asked if the Council was interested in an Ordinance as <br />Cambridge, Massachusetts adopted requiring restaurants to install <br />condom machines and requested the Health Department look into this <br />possibility. (3) Mayor Morris attended a luncheon with <br />Governor-Elect Richards and fourteen other Mayors. Governor-Elect <br />Richards asked for input from cities and made a commitment to <br />support and hear from the cities. (4) Mr. Guerra has been asked by <br />the Texas Department of Commerce to serve on a Local Community Focus <br />Group in early February to draft economic development policies to <br />assist cities. (5) Mr. Guerra has been asked by TML to be the <br />Master of Ceremonies at the Legislative Symposium in San Antonio. <br />Mayor Morris introduced for consideration an Executive Session <br />(includes Addendum) pursuant to Article 6252-17, Sections 2(e) and <br />(f), V.A.C.S., to discuss pending litigation (Tom Leining vs. Jesse <br />Saucedo, Et Al; GBRA vs. City of Lytle, Et Al), contemplated <br />litigation and matters where the duty of the City Attorney to the <br />City pursuant to the Code of Professional Responsibility of the <br />State Bar of Texas clearly conflicts with Article 6252-17; purchase <br />of real property and lease of real property, respectively. Mr. <br />Plummer moved the Council adjourn into Executive Session at 10:45 <br />p.m. and Mr. Moore seconded the motion, which passed unanimously. <br />Mr. Guerra moved the Council reconvene at 12:30 a.m. and Mr. Hart <br />seconded the motion, which passed unanimously. <br />
