FUNDING AGREEMENT BETWEEN CITY OF SAN MARCOS AND <br /> SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL <br /> DISTRICT <br /> Contract # <br /> This Agreement(the"Agreement") is entered into by and between the City of San Marcos, <br /> a Texas municipal corporation (the "City") and the San Marcos Consolidated Independent School <br /> District, San Marcos, Texas (the "Recipient")and is effective for all purposes as of the date of the <br /> last signature of this Agreement("Effective Date"). <br /> I. RECITALS <br /> 1.1 The U.S. Treasury has initiated the Coronavirus State and Local Fiscal Recovery <br /> Funding (CSLFR) through the American Rescue Plan Act(ARPA)for the purpose of aiding state <br /> and local communities in responding to public health and economic impacts created by the <br /> coronavirus pandemic. <br /> 1.2 Recipient provides an emergency shelter location supporting the wellbeing and safety <br /> of the San Marcos community in the event of an emergency or crisis. <br /> II. USE OF FUNDS <br /> Recipient will utilize these funds to provide continued services to support the recovery of the <br /> San Marcos community.Use of funds by the Recipient will be for qualifying expenses as set forth by the <br /> U.S. Treasury Coronavirus State and Local Fiscal Recovery Funds, 31 CFR Part 35. <br /> IH. CITY OBLIGATION <br /> 3.1 By City Council Meeting held on December 5,2023, $445,000 from CSLFR funds will <br /> be provided to the Recipient for the purpose of supporting the San Marcos Consolidated Independent <br /> School District, San Marcos, Texas through funding that will provide for installation of a new <br /> generator at San Marcos High School that would allow the high school gym to serve as an emergency <br /> shelter.This cost includes a 600-kilowatt diesel generator, automatic transfer switch,electrical installation, <br /> and associated engineering services. <br /> 3.2 The funding under this Agreement will be made from appropriations made to the City <br /> by the U.S. Treasury through the CSLFR funds. <br /> 3.3 The City will disburse to the Recipient an amount not to exceed $445,000 by check or <br /> wire transfer, at the City's sole option within five(5)business days of contract execution. <br /> IV. RECEPIENT OBLIGATION <br /> Recipient shall utilize CSLFR funds for the installation of a generator at San Marcos High <br /> School in San Marcos, Texas for the purpose of the activating and utilizing the high school gym <br /> serving as an emergency shelter.
