RESOLUTION NO. 2023-204R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN AGREEMENT WITH ARA <br /> PROPERTIES II, A TEXAS GENERAL PARTNERSHIP, FOR THE CITY <br /> TO PURCHASE A 0.069 ACRE UTILITY EASEMENT IN THE VICINITY <br /> OF THE INTERSECTION OF STATE HIGHWAY123 AND DE ZAVALA <br /> DRIVE, FOR $69,206.00 PLUS CLOSING COSTS FOR THE SH 123/DE <br /> ZAVALA INTERSCTION IMPROVEMENTS PROJECT; AUTHORIZING <br /> THE CITY MANAGER, OR HER DESIGNEE, TO EXECUTE CLOSING <br /> DOCUMENTS PURSUANT TO THIS AGREEMENT ON BEHALF OF THE <br /> CITY; AND DECLARING AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Agreement (Agreement) with ARA Properties II, a Texas <br /> General Partnership, for the City to purchase a utility easement for $69,206.00 plus closing costs, <br /> for the SH 123/De Zavala Drive Improvements Project is hereby approved. <br /> PART 2. The City Manager,or her designee, is authorized to execute said Agreement <br /> and related documents for closing the purchase, on behalf of the City. <br /> PART 3.
