0 ORDINANCE NO. 2009 - 61 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 2, ADMINISTRATION, <br />ARTICLE 2, CITY COUNCIL, OF THE SAN MARCOS CITY CODE TO <br />ADD A NEW SECTION 2.024, COUNCIL COMPENSATION; <br />INCLUDING PROCEDURAL PROVISIONS; AND, ESTABLISHING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. In a special election held in November 2008, the Citizens of San Marcos approved <br />various revisions to the San Marcos City Charter including a revision to Section 3.04 to allow the <br />City Council, by ordinance adopted in a public forum, to set a level of compensation. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS: <br />SECTION 1. Chapter 2, Administration, Article 2, City Council, Division 1, of the San <br />Marcos City Code is amended to add a new Section 2.024 to read as follows (underlining <br />indicates added text): <br />• <br />2.024 Council Compensation <br />(a) The compensation for each council member is set at the sum of $500.00 per month. <br />This sum may be taken, in the alternative, as an addition to a council member's reimbursable <br />expense account and used for the purposes set forth by resolution of the council. A council <br />member is not obligated to accept the compensation or additional funds for expenses authorized <br />under this subsection. <br />(b) The compensation for the mayor is set at the sum of $750.00 per month. This sum <br />may be taken, in the alternative, as an addition to the mayor's reimbursable expense account and <br />used for the purposes set forth by resolution of the council. The mayor is not obligated to accept <br />the compensation or additional funds for expenses authorized under this subsection. <br />Section 2: If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />0
