<br />38 <br /> <br /> <br /> <br />Regular Meeting April 22, 1991 Page 6 <br /> <br /> <br />Ms. Kissler moved the Council reconsider the consensus agenda, Item <br />8, to include the emergency addendum, Item 8.I., and Mr. Plummer <br />seconded the motion, which passed unanimously. Ms. Kissler then <br />moved to approve Change Order No.2 for Hunter Industries, Inc. in <br />the amount of $8,517.00 in connection with the Reconstruction of <br />Runway 8-26 and Associated Runways and Taxiways and Mr. Plummer <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />advised the Council the Public utility Commission has filed its <br />Final Order regarding the Wholesale Power Rate Case. He advised the <br />City was denied its request for reimbursement of expenses, and that <br />LCRA asked for a 12% increase in their Original Petition but was <br />only granted a 3.29% increase system-wide (6.2% for San Marcos). <br />Additionally, the standby rate by LCRA was eliminated, which would <br />be a savings of at least $250,000 annually for San Marcos. Mr. <br />Gilley advised the City's attorneys would have a recommendation <br />forthcoming whether or not to request a Rehearing within 20 days of <br />the Final Order if San Marcos wants to proceed with what was denied. <br /> <br />Mayor Morris introduced the City Attorney's Report. (1) Mr. Taylor <br />advised in connection with the State's Financial Responsibility, the <br />Court of Civil Appeals will be working on conclusions regarding <br />outstanding cases. (2) Mr. Taylor advised the Council Mike <br />McGregor, the Assistant City Attorney, has resigned to accept a <br />position as a Special Agent with the FBI. <br /> <br />Mayor Morris introduced the City Council's Report. The Council had <br />no report at this meeting. <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, Sections 2(e) and (g), V.A~C.S., to discuss contemplated <br />litigation and matters where the duty of the City Attorney to the <br />City pursuant to the Code of Professional Responsibility of the <br />State Bar of Texas clearly conflicts with Article 6252-17, and <br />evaluation of a public employee (City Attorney), respectively. Mr. <br />Hart moved to adjourn into Executive Session at 10:31 p.m. and Mr. <br />Hernandez seconded the motion, which passed unanimously. <br /> <br />Mr. Hernandez moved to reconvene at 12:58 a.m. and Mr. Moore <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval to set the salary <br />of the City Attorney.
