SECTION 4. A new Division 3 is created by adding the following title <br /> immediately preceding Section 82.066: <br /> DIVISION 3. TRAFFIC CONTROL DEVICES <br /> SECTION 5. Section 82.067 of the San Marcos City Code is hereby amended as set <br /> forth below. <br /> See. 82.067. Traffic register. <br /> The traffic engineer shall develop and maintain a traffic register containing <br /> a record of every location in the city where any traffic control device or special <br /> regulation is made applicable, whether by ordinance or by the traffic engineer's <br /> authority established. under this chapter. The traffic register shall be continuously <br /> maintained by the traffic engineer-and. made publicly available as an interactive <br /> map on the city's Open Data Portal or other publicly accessible location on the <br /> city's website. The interactive map shall be accompanied by links or references to <br /> applicable definitions of each device and regulations. All persons shall be charged <br /> with notice of it-is the contents of the traffic register. Defects, omissions, or entries <br /> of the traffic register shall not constitute a defense to prosecution for trafficlaw <br /> violations. Whenever any traffic control device or special regulation no longer <br /> applies in the city, the record of the location shall remain in the traffic register but <br /> shall be prominently marked "deleted" by the traffic engineer, who shall also note <br /> the date of the deletion and the authority therefor. <br /> SECTION 6. Section 82.159 of the San Marcos City Code is hereby amended as set <br /> forth below. <br /> See. 82.159. Penalties for parking violations. <br /> (a) A person who violates this article shall be liable for a civil penalty <br /> (except for disabled parking violations) of not moFe+".-.m 11 <br /> 4'-" nn- �U+'not less that] <br /> the following lexeept disabl.eA4 1�+4 <br /> paf11——... as follows: <br /> (1) Level one violations ($60.00*$2-0-.-00) <br /> Parked overtime <br /> Parked within 20 feet of crosswalk <br /> Wheels more than 18 inches from the curb <br /> Parked on wrong side of the street <br /> [If a motion to amend is approved on <br /> second reaLding,_tlien add: Non-electric <br /> vehicle parked in electric vehicle space <br /> without charging] <br />
