<br /> 49 <br /> Special Meeting May 6, 1991 Page 2 <br /> AYE: Moore, Hernandez, Morris, Guerra, Kissler, Plummer. <br /> NAY: None. <br /> ABSTAIN: Hart. <br /> Mayor Morris introduced for consideration adoption of a Resolution, <br /> the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE SUBMISSION OF A PRE-APPLICATION TO THE <br /> TEXAS DEPARTMENT OF COMMERCE FOR THE TEXAS CAPITAL FUND LOAN <br /> PROGRAM IN CONNECTION WITH THE PROPOSED BUILDING AT 224 NORTH <br /> GUADALUPE BY THE SOUTHWEST TEXAS STATE UNIVERSITY SUPPORT <br /> FOUNDATION; AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Moore stated he would abstain from discussiong or voting on <br /> this matter and left the Council Chambers. Ms. Kissler moved for <br /> adoption of the Resolution and Mr. Hart seconded the motion. This <br /> pre-application would be for $170,000, the total project would be <br /> for $978,000. The Bank (State Bank and Trust Company) would have a <br /> first lien, and the City would have a second lien. The Council <br /> requested a written commitment from the SWTSU Support Foundation to <br /> leave the property and equipment on the tax roles and want more <br /> information by the application stage regarding the City's second <br /> lien position. On roll call the following vote was recorded: <br /> AYE: Hernandez, Hart, Morris, Guerra, Kissler, Plummer. <br /> NAY: None. <br /> ABSTAIN: Moore. <br /> Mayor Morris introduced for consideration approval of award of bid <br /> for the Northeast IH35 Water Line Extension, Phase II Project. Ms. <br /> Kissler moved to award bid to M. C. Etheridge Company of New <br /> Braunfels, Texas in the amount of $85,767.49 and Mr. Guerra seconded <br /> the motion, which passed unanimously. <br /> Mayor Morris introduced an Executive Session pursuant to Article <br /> 6252-17, Sections 2(e) and (g), V.A.C.S., to discuss matters where <br /> the duty of the City Attorney to the City pursuant to the Code of <br /> Professional Responsibility of the State Bar of Texas clearly <br /> conflicts with Article 6252-17, and duties of a public officer. Mr. <br /> Plummer moved to adjourn at 6:31 p.m. and Ms. Kissler seconded the <br /> motion, which passed unanimously (Mr. Guerra left the meeting at <br /> 6:30 p.m.). <br /> Mr. Plummer moved to reconvene from Executive Session at 7:28 p.m. <br /> and Ms. Kissler seconded the motion, which passed unanimously. <br /> The meeting adjourned at 7:31 p.m. on motion made by Ms. Kissler and <br /> seconded by Mr. Hernandez. <br /> mJVttMAn <br /> ~~.~ <br /> L <br />
