ORDINANCE NO.2011-39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE LAND USE PLAN AND DEVELOPMENT STANDARDS FOR THE PASO ROBLES PDD PREVIOUSLY APPROVED BY ORDINANCE NO. 2010-59 TO REFLECT THE REMOVAL OF THE NORTH -SOUTH ARTERIAL ROADWAY LOCATED ALONG THE WESTERN BOUNDARY OF THE PROJECT SITE (THE WESTERN ARTERIAL) AND THE COLLECTOR FROM THE SOUTHEAST CORNER OF THE PROJECT SITE FROM THE PROPOSED THOROUGHFARE NETWORK DESCRIBED THEREIN; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE RECITALS: 1. On October 5, 2010, the City Council approved a Land Use Plan and Development Standards for the Paso Robles PDD. 2. Pursuant to said Land Use Plan and Development Standards, certain public roadways were proposed to include a north -south arterial roadway along the western boundary of the Project Site (the "Western Arterial") and a collector street from the southeast corner of the Project Site (the "Collector Street") as shown in the Concept Plan and other maps and drawings therein. 3. The City and the owner of the Project Site have determined that such proposed public roadways do not currently need to be included in the Land Use Plan and Development Standards and wish to amend the document to reflect the removal of such proposed roadways. 4. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Paso Robles PDD Land Use Plan and Development Standards approved by Ordinance No. 2010-59 is hereby amended as follows: a) The original Concept Plan is deleted and replaced with the Conceptual Land Use Plan attached hereto as Exhibit "A" (the "New Concept Plan"). b) All maps, drawings or illustrations are, hereby amended to reflect the elimination of the Western Arterial and the Collector Street and new maps, drawings and illustrations consistent with this Ordinance may be attached to the Land Use Plan and Development Standards to replace the originals. In the event of any conflict between the
