MEMORANDUM ®F UNDERSTANDING <br /> FOR USE OF FACILITIES IN THE EVENT OF EMERGENCY OR DISASTER <br /> This Agreement is made and entered into Apr 17, 2024 _, by and between the City of Sall <br /> Marcos, Texas ("City), a Texas home rule municipality, and the San Marcos Consolidated <br /> Independent School District ("District"), a Texas public independent school district, and jointly <br /> referred to as the " Parties." <br /> Recitals. <br /> Whereas, in the event of a catastrophic disaster or emergency, resources may be needed to <br /> provide shelter or provide necessary services; <br /> Whereas, the City desires to enter into a Memorandum of Understanding ("MOU") with the <br /> District; and <br /> Whereas, the City and the District desire to enter into this MOU for the purpose of use of <br /> designated District facilities by the City as alternative evacuation shelter in the event of an <br /> emergency or disaster; and <br /> Whereas, the District finds that entering into this MOU with the City serves a public purpose by <br /> providing temporary shelter to the citizens of San Marcos, Hays County Texas; and <br /> For the reasons stated in these Recitals and the mutual benefits and obligations herein, the Parties <br /> wish to enter into this Agreement <br /> Now,Therefore,in consideration of the foregoing recitals and the terms,conditions,covenants, <br /> and agreements set forth herein,the Parties agree as follows: <br /> 1. Purpose. The purpose and intent of this Agreement is to provide for the emergency use of <br /> the following District facilities for the purpose of providing an alternative temporary <br /> shelter for evacuees due to an emergency or government declared disaster. <br /> 2. Duration. This Agreement shall be for a term of three of years from the date of the initial <br /> agreement. Following the initial three-year term,the Parties may agree in writing to renew <br /> the MOU for a period of two additional years. Either party may terminate this agreement <br /> with or without cause by providing the other patty with thirty (30) days written notice to <br /> the designated representative of the other party. unless terminated earlier upon a breach of <br /> this Agreement by a party pursuant to Section 2.1 below. <br /> 2.1 Upon breach of this Agreement by either party, the other party shall give written <br /> notice of the intent to terminate the Agreement specifying the claimed breach and <br />
