RESOLUTION NO. 2024-97R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN AMENDED AGREEMENT <br /> PROVIDING FOR REVISED RATES AND QUANTITIES IN THE CITY'S <br /> AGREEMENT FOR THE SALE OF EDWARDS AQUIFER WATER ON A <br /> TEMPORARY BASIS TO THE COUNTY LINE SPECIAL UTILITY <br /> DISTRICT AND EXTENDING THE AGREEMENT THROUGH 2026; <br /> AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO <br /> EXECUTE THE AMENDED AGREEMENT ON BEHALF OF THE CITY; <br /> AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. In March 2021, the City of San Marcos and County Line Special Utility District <br /> (CLSUD) entered a water sharing agreement through the Alliance Regional Water Authority <br /> (ARWA)for the temporary assignment of Edwards Aquifer water rights until the year after ARWA <br /> Phase 1 is fully completed. The Agreement was for 630 ace-feet (AF) annually at a price of <br /> $3.21/1,000 gallons with a minimum monthly payment of$7,745 to the City. <br /> 2. CLSUD anticipates the need for additional Edwards Aquifer Water under the City's <br /> permit for the remainder of 2024 through 2026,which is one year longer than the ARWA Phase 1 <br /> construction completion. <br /> 3. The City has supplies above and beyond their current needs within its EAA permit <br /> limits and is willing to make available, from its EAA permitted water supply, 500 AF through the <br /> remainder of 2024 and 2025-2026. <br /> 4. The City now wishes to extend the existing agreement by one year, reducing the <br /> amount of water in the agreement from 630 AF to 500 AF, increasing the price to $3.43/1,000 <br /> gallon, and increasing the minimum monthly due from $7,745 to $23,149. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Amended Agreement with the County Line Special Utility <br /> District providing for revised rates and quantities in the City's Agreement for the sale of Edwards <br /> Aquifer water on a temporary basis and extending the Agreement through 2026 is approved. <br /> PART 2. The City Manager, or her designee, is authorized to execute said Amended <br /> Agreement on behalf of the City. <br /> PART 3. This resolution shall be in full force and effect immediately from and after <br /> its passage. <br /> ADOPTED on June 4, 2024. <br />
