RESOLUTION NO. 2024-95R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,TEXAS APPROVING AN ADVANCE FUNDING AGREEMENT (AFA) (CSJ NO. 0016-03-128) WITH THE STATE OF TEXAS, ACTING THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION (TXDOT) FOR A TRANSPORTATION ALTERNATIVES SET-ASIDE (TASA) PROJECT FOR THE IH-35 SHARED USE PATHWAY CONNECTION PROJECT; AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE,TO EXECUTE SAID AGREEMENT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on October 26, 2023, via Minute Order 116575, the Texas Transportation Commission authorized the IH 35 Shared Use Pathway Connection project(the"Project)to receive Transportation Alternatives Set-Aside (TASA) funds for project construction and Texas Department of Transportation (TxDOT or the State) oversight; and WHEREAS, the TASA funds require a local match, the City of San Marcos commits to provide the match. The local match is comprised of cash or Transportation Development Credits (TDCs); and WHEREAS, the City of San Marcos is responsible for all non-reimbursable costs and 100%of overruns, if any; and WHEREAS, the City Council of the City of San Marcos desires to reaffirm its support of the Project and approve and authorize the execution of an Advance Funding Agreement (AFA) with TxDOT for the Project;NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Advance Funding Agreement (AFA) with the Texas Department of Transportation for a Transportation Alternatives Set-Aside (TASA)project for the TH35 Shared Use Pathway Connection project ("the Project") (CSJ No. 0016-03-128) is hereby approved. PART 2. The City Manager, or her designee, is authorized to execute said agreement on behalf of the City. PART 3. This resolution shall be in full force and effect immediately from and after its passage. ADOPTED on June 4, 2024.
