RESOLUTION NO. 2024-98R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN AMENDED AGREEMENT <br /> PROVIDING FOR THE CITY TO SELL ADDITIONAL POTABLE <br /> TREATED WATER ON A WHOLESALE BASIS TO THE COUNTY LINE <br /> SPECIAL UTILITY DISTRICT FOR AN ADDITIONAL TWO YEARS <br /> WITH THE OPTION FOR FURTHER EXTENSIONS; AUTHORIZING <br /> THE CITY MANAGER, OR HER DESIGNEE, TO EXECUTE THE <br /> AMENDED AGREEMENT ON BEHALF OF THE CITY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City of San Marcos approved an agreement in 2023 to sell potable treated water <br /> on a wholesale basis to the County Line Special Utility District. <br /> 2. County Line Special Utility District (CLSUD) has requested an additional water <br /> supply for two years of up to 1.5 million gallons a day,which is 0.5 MGD increase over the existing <br /> agreement. <br /> 3. SMTXU has the capacity to provide this additional water and the City Council of <br /> the City of San Marcos now wishes to approve an amendment to the Agreement. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Amended Agreement with the County Line Special Utility <br /> District allowing for the sale of additional potable treated water on a wholesale basis for an <br /> additional two years with options for further extensions with SMTXU approval is approved. <br /> PART 2. The City Manager, or her designee, is authorized to execute said amended <br /> agreement on behalf of the City. <br /> PART 3. This resolution shall be in full force and effect immediately from and after <br /> its passage. <br /> ADOPTED on June 4, 2024 <br /> Jane Hughsor <br /> Mayor <br />
