(24) Be illuminated by lighting attached to the sign or by other lighting sufficient <br /> to make the sign readable by lighting a#aehed to the sign of by other-lighti <br /> fit suffleient to make the sign iva if non-consent tows are <br /> performed between the hours of sunset and sunrise; <br /> (e) An additional sign meeting the speeifieations attaelied to this efd' <br /> Exhibit "A" must be posted at eXit from the pafking f4eility <br /> to an ad1joining stfeet of alley. <br /> (cd) It is a defense to prosecution under this section that the parking facility <br /> owner has given notice in a manner other than by posted signs, in <br /> accordance with the Texas Occupations Code, Chapter 2308, as amended, <br /> to the owner or operator of a vehicle that the vehicle will be towed if it is <br /> not removed from the parking facility. <br /> (de) It is a defense to prosecution under this section that the vehicle being towed: <br /> (1) Is in or obstructs a vehicular traffic aisle, entry, or exit of the parking <br /> facility; <br /> (2) Prevents a vehicle from exiting a parking space at the facility; <br /> (3) Is in or obstructs a marked fire lane; <br /> (4) Is in a space designated for vehicles transporting disabled persons, and does <br /> not display a special license plate or placard for a vehicle that transports a <br /> disabled person; or <br /> (5) Is in or obstructing a part of a driveway used for entering or existing the <br /> facility. <br /> See. 90.241. Rotation system registration. <br /> (a) Each wrecker service that meets the qualifications under subsection(b)may <br /> elect to participate in the peliee depaftmeiA City of San Marcos rotation <br /> system for performing police-authorized tows by submitting a fully <br /> completed rotation system registration form to the Chief of Po City <br /> Marshal. The registration form must contain, at a minimum, all of the <br /> following information regarding the wrecker service: <br /> (1) The business name, address, telephone number and fax number. <br /> (2) The name, address, and phone number of each principal person of the <br /> service. <br /> (3) The normal business hours. <br /> (4) The name and telephone number of the person designated by the service for <br /> taking after-hours calls. <br /> (5) The name of the operator and the address and phone number of the storage <br /> facility to which the service will tow vehicles. <br /> The registration form must be accompanied by a current certificate of <br /> insurance for the wrecker service. The certificate must list the city as an <br />
