SUBAWARD NO.001 <br /> the manufadUre of such rolling stock. After reviewing the report and visually inspecting <br /> and road testing the delivered vehicles, the vehicles meet the contract specifications. The <br /> inspector's report inclUdes the following: <br /> (i) Provide accurate records of all vehicle construction activities; and <br /> (i i) Address hoW the construction and operation of the vehicles fulfills <br /> the contract specifications. <br /> (4) Manufacturer's Federal Motor Vehicle Safety Standard Self- <br /> Certification. If federal motor vehicle standards do not apply, the recipient must provide <br /> a certification from the manufacturer stating such. if the standards do apply, a recipient <br /> shall keep on file its certification that it received, both at the pre-award and post-delivery <br /> stage, a copy of the manufacturer's self-certification information that the vehicle complies <br /> with relevant Federal Motor Vehicle Safety Standards. <br /> (5) Distracted Driving. In accordance with section 34(b)(3(iii) of the FTA <br /> Master Agreement: <br /> (i) Safely. The Sub-Recipient agrees to adopt and enforce workplace <br /> safety policies to decrease crashes caused by distracted drivers, including policies to <br /> ban text messaging while using an electronic device supplied by an employer, and <br /> driving a vehicle the driver owns or rents, a vehicle Sub-Recipient owns, leases, or <br /> rents, or a privately-owned vehicle when on official business in connection with the <br /> Award,or when performing any work f'or or on behalf of the Award. <br /> (i i) Recipient .Size. The Sub-Recipient agrees to conduct workplace safety <br /> initiatives in a manner commensurate with its size, such as establishing new rules and <br /> programs to prohibit text messaging while driving, re-evaluating the existing programs <br /> to prohibit text messaging while driving,and providing education,awareness,and other <br /> outreach to employees about the safety risks associated with texting while driving. <br /> XV.TERMINATION <br /> 15.1 Termination for Cause. <br /> (a) City reserves the right, with ninety (90) days advance written notice of <br /> default to Sub-Recipient, to terminate this Agreement and withhold all payments of funds <br /> in the event of any of the following circumstances: <br /> (I) Sub-Recipient has breached or failed to perform any term or <br /> condition of this Agreement; <br /> (2) Sub-Recipient has violated the terms of FTA's Master Agreement <br /> or other Federal requirement;or <br /> (3) Sub-Recipient fails to make progress in the performance of the <br /> Page 18 of 30 <br />
