The Sub-Recipient agrees to aclopt and enforce workplace safety policies to decrease crashes caused by distracted drivers, including policies to ban text messaging while using an electronic device supplied by an employer, and driving a vehicle the driver owns or rents, a vehicle Sub-Recipient owns, leases, or rents, or a privately-owned vehicle when On official business in connection with the Award, or when performing any work for or on behalf of the Award. (i i) Recipient Size. The Sub-Recipient agrees to conduct workplace safety initiatives in a planner commensurate with its size, such as establishing new rules and programs to prohibit text messaging while driving,re-evaluating the existing programs to prohibit text messaging while driving,and providing education,awareness,and other outreach to employees about the safety risks associated with testing while driving. XV.TERMINATION 15.1 Termination for Cause. (a) City reserves the right, with ninety (90) clays advance written notice of clefault to Sub-Recipient, to terminate this Agreement and withhold all payments Of funds in the event of any of the following circumstances: (1) Sub-Recipient has breached or failed to perform any term Or condition Of this Agreement; (2) Sub-Recipient has violated the terms of FTA's Master Agreement or other Federal requirement; or (3) Sub-Recipient fails to make progress in the performance of the Page 18 of 30
