� Q <br />M IIJ <br />ORDINANCE 1993- <br />kill <br />..� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />v MARCOS, TEXAS, AMENDING CHAPTER 25, STREETS, <br />SIDEWALKS, RIGHT-OF-WAY CONSTRUCTION AND OFF-STREET <br />PARKING, OF THE SAN MARCOS CODE OF ORDINANCES WITH <br />REGARD TO PUBLIC HEARING NOTIFICATION PROCEDURES <br />FOR STREET NAME CHANGES; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; <br />PROVIDING FOR PUBLICATION AND PROVIDING AN <br />EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That Subsections (b), (d) and (h) of <br />Section 25-8 of Chapter 25, Streets, Sidewalks, Right -of -Way <br />Construction and Off -Street Parking of the San Marcos Code of <br />Ordinances are amended to read as follows: <br />(b) The petition shall be considered initially by <br />the planning commission, and shall be considered only if more <br />than fifty percent (50%) of the owners of businesses <br />addressed along the street and more than fifty percent (50%) <br />of the owners of property addressed along the street in <br />question, insofar as they can reasonably be determined, have <br />signed the petition in favor of the change. <br />(d) Notice of the public hearing by the planning <br />commission shall be given by publication one time in a <br />newspaper of general circulation in the city, and by first <br />class mail to all owners of businesses addressed along the <br />street and owners of property addressed along the street, <br />insofar as they can reasonably be determined, at least ten <br />(10) days in advance of the hearing. <br />(h) The Planning and Development Services <br />Department shall notify the appropriate emergency service <br />agencies, gas telephone, public utility companies, all <br />appropriate city and county offices, the U.S. Post Office and <br />the San Marcos Consolidated Independent School District of a <br />street name change. <br />SECTION 2. That Subsections (b), (c) and (f) of <br />Section 25-9 of Chapter 25, Streets, Sidewalks, Right -of -Way <br />Construction and Off -Street Parking, of the San Marcos Code <br />of Ordinances are amended to read as follows: <br />(b) A city -initiated street name change under <br />subsections (a)(1) or (2) above shall initially be considered <br />by the planning commission, which shall conduct a public <br />hearing on the proposed change. Notice of this hearing shall <br />be given by publication one time in a newspaper of general <br />circulation in the city, and by first class mail to all <br />owners of businesses addressed along the street and all <br />owners of property addressed along the street, insofar as <br />they can reasonably be determined, at least ten (10) days in <br />advance of the hearing. <br />(c) A city -initiated street name change under <br />subsection (a)(3) or (4) above shall initially be considered <br />by the planning commission only if the city has obtained the <br />consent to the change of more than fifty percent (50%) of the <br />owners of businesses addressed along the street and more than <br />fifty percent (50%) of the owners of property addressed along <br />the street in question, insofar as they can reasonably be <br />determined. The planning commission shall conduct a public <br />hearing on the proposed change. Notice of this public <br />hearing shall be given by publication one (1) time in a <br />newspaper of general circulation in the city, and by first <br />class mail to all owners of businesses addressed along the <br />street and owners of property addressed along the street, <br />insofar as they can reasonably be determined, at least ten <br />(10) days in advance of the hearing. <br />(f) The city council shall hold a public hearing, <br />and shall apply the criteria described in subsection (d) <br />
