1311 <br />J <br />13 <br />ORDINANCE 1993- <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING 0.18 ACRE, <br />MORE OR LESS, OF LAND AREA, BEING A PART OF <br />FARM LOT NO. TEN (10) OF THE CITY OF SAN <br />MARCOS, IN HAYS COUNTY, TEXAS, ACCORDING TO <br />THE MAP OR PLAT OF THE TOWN, LOCATED AT 220 S. <br />JOHNSON STREET FROM "MF-4" MULTI -FAMILY <br />DISTRICT (HIGH DENSITY) TO "R-1" SINGLE-FAMILY <br />DWELLING DISTRICT (LOW DENSITY) AND DECLARING <br />AN EFFECTIVE DATE. <br />WHEREAS, on May 4, 1993, the Zoning Commission of the City of <br />San Marcos held a public hearing regarding a request to change the <br />zoning from "M-4" Multi -Family District (high density) to "R-1" <br />Single -Family Dwelling District (low density) for 0.18 acres more <br />or less of land area being a part of Farm Lot No. Ten (10) of the <br />City of San Marcos, in Hays County, Texas, according to the map or <br />plat of the town, and also being a part of that certain tract of <br />3.47 acres of land, conveyed by and described in a deed from San <br />Marcos Independent School District to S.H. Shafer, dated July 24, <br />1942, recorded in Volume 125, Pages 41-44, of the Hays County Deed <br />Records, located at 220 S. Johnson Street; and, <br />WHEREAS, subsequent to the public hearing on that date, the <br />Commission did, on May 4, 1993 consider the request and voted to <br />approve it and has recommended that the request be approved by the <br />City Council of the City; and, <br />WHEREAS, the City Council held a public hearing on the 28th <br />day of June , 1993, regarding the request; and, <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br />WHEREAS, the City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS® <br />SECTION 1. That the Official Zoning Map of the City, as <br />described in Section 3 of the General Zoning Ordinance, is hereby <br />amended to rezone the following described real property located in <br />San Marcos, Hays County, Texas, which is presently zoned "MF-4" <br />Multi -Family District (high density) to "R-1" Single -Family <br />Dwelling District (low density); <br />Being a part of Farm Lot No. Ten (10) of the City of San <br />Marcos, in Hays County, Texas, according to the map or <br />plat of said town, and also being a part of that certain <br />tract of 3.47 acres of land, conveyed by and described in <br />a deed from San Marcos Independent School District to <br />S.H. Shafer, dated July 24, 1942, recorded Volume 125, <br />Pages 41-44, Hays County Deed Records, and the tract <br />conveyed hereL y may be more accurately described by metes <br />and bounds as follows® <br />BEGINNING at 'Che most Northern corner of said tract of <br />3.47 acres of land, described in the deed above <br />mentioned, at --he intersection of the Southwest line of <br />Johnson Avenue (or Meacham Street) and the Southeast line <br />of a 20 foot alley; <br />THENCE in a Southeasterly direction with the said line of <br />Johnson Avenue (or Meacham Street) , 80 feet, to stake for <br />corner; <br />
