RESOLUTION 1993 - R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A SOFTWARE MAINTENANCE AGREEMENT <br />BETWEEN THE CITY AND NETWORK COMPUTING <br />CORPORATION; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City uses certain computer software under license <br />from Network Computing Corporation {NCC}, and has had maintenance <br />of this software performed by NCC under an agreement dated October <br />14, 1986; and, <br />WHEREAS, the City wishes to enter into a revised software <br />maintenance agreement with NCC in order to obtain the benefits of <br />an expanded level of maintenance services; and, <br />WHEREAS, these software maintenance services are available <br />only from NCC; now, therefore, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: - <br />PART 1. That the terms and conditions of the Software <br />Maintenance Agreement attached to this Resolution between the City <br />and NCC are hereby approved. <br />PART 2. That the sole source procurement of the services <br />covered by this agreement, without competitive bidding or <br />proposals, is hereby approved. <br />PART 3. That the City Manager, Larry D. Gilley, is hereby <br />authorized to execute this Agreement on behalf of the City. <br />PART 4.
