What materials does the BAP apply to? <br /> The BAP requires that all iron, steel, manufactured products, and construction materials <br /> used in infrastructure projects funded with Federal financial assistance must be produced in <br /> the United States. <br /> 5. What does "produced in the United States" mean for materials to which the BAP <br /> applies? <br /> The term"produced in the United States," as defined in 2 CFR 184.3,means: <br /> • in the case of iron or steel products,that all manufacturing processes, from the initial <br /> melting stage through the application of coatings, occurred in the United States. <br /> • in the case of manufactured products that: <br /> o the product was manufactured in the United States; and <br /> o the cost of components of the manufactured product that are mined, <br /> produced, or manufactured in the United States is greater than 55 percent of <br /> the total cost of all components of the manufactured product,unless another <br /> standard that meets or exceeds this standard has been established under <br /> applicable law or regulation for determining the minimum amount of <br /> domestic content of the manufactured product; and <br /> • in the case of construction materials,that all manufacturing processes for the <br /> construction material occurred in the United States. <br /> CPD Program Specific <br /> 6. Which CPD programs are subject to the BAP? <br /> Any CPD program that can be used for the purpose of infrastructure as defined by BABA. <br /> These programs are considered Covered CPD programs. <br /> 7. Which CPD funds or programs are NOT subject to the BAP? <br /> The BAP does not apply to Federal funds for "pre and post disaster or emergency <br /> response" according to BABA. Therefore, at the time of publication of this notice,the BAP <br /> does not apply to the following CPD funds or programs that administer disaster related FFA: <br /> • Community Development Block Grant Disaster Recovery Funds (CDBG-DR) <br /> • Community Development Block Grant Mitigation(CDBG-MIT) <br /> • Community Development Block Grant—National Disaster Resilience Competition <br /> (CDBG-NDR) <br /> • Community Development Block Grant CARES Act(CDBG-CV) <br /> • Housing Opportunities for Persons With AIDS CARES Act(HOPWA-CV) <br /> • Emergency Solutions Grants CARES Act(ESG-CV) <br /> The Community Compass Technical Assistance program is also excluded from the BAP as <br /> the program does not fund any covered infrastructure activities. <br /> 22 <br />
