protection services to the Property unless and until the Property is annexed into the City <br /> for full-purposes. <br /> Section 5.09 Police Protection. The City shall have no obligation to provide police <br /> protection services to the Property unless and until the Property is annexed into the City <br /> for full purposes,and at such time,the City will provide the Property with the same level <br /> of police protection services as the remainder of the City. By separate agreement, each <br /> District may request and receive supplemental police protection services from the City. <br /> Section 5.10 Owners Associations. Prior to the sale of any platted lots within the <br /> Property, Owners and/or Developer shall establish one or more property owners <br /> associations with one or more architectural control committees, which committees shall <br /> govern the architectural elements of all physical structures in accordance with the <br /> property owners association design guidelines. The purpose of the property owners <br /> association(s) will be to ensure a consistent quality and appearance of improvements and <br /> to maintain landscaping and exterior features, including parks, trails and open space on <br /> the Property. No City rules or regulations related to architectural design shall apply. <br /> Section 5.11 Qy Fees. The City shall not charge any impact fees, capital recovery fees, <br /> permit fees associated with construction of public infrastructure, parkland dedication <br /> fees, subdivision review fees,inspection fees, or other similar fees in connection with the <br /> development of the Project except (i) as otherwise provided in this Agreement and (ii) <br /> the applicable Subdivision Review Fees and Site Fees set forth in Ordinance 2019-25, or <br /> as later amended. <br /> ARTICLE VI. <br /> WATER AND WASTEWATER SERVICE <br /> Section 6.01 Water and Wastewater Service. <br /> (a) River Bend is located within the water certificate of convenience and necessity <br /> ("CCN")held by Crystal Clear Special Utility District("CCSUD").River Bend will <br /> receive water service from CCSUD unless water service is requested from the City <br /> in accordance with the applicable Utility Agreement. Riley's Pointe shall receive <br /> water service from the City. For the portion of the Property to which the City will <br /> provide water service, each phase of the related water supply and distribution <br /> facilities constructed by or on behalf of the District(s),to serve the District(s), shall <br /> be conveyed upon completion to the City for ownership, operation, and <br /> maintenance and become part of the City's water system in accordance with the <br /> Utility Agreement(s). Users within the Property receiving water service from the <br /> City shall be customers of the City. Rates and charges for such customers shall be <br /> equal and uniform to those charged to other similar classifications of users <br /> receiving water service that are not located within the City. <br /> 11 <br /> 960915_5 <br />
