is <br /> I' <br /> Exhibit"F" <br /> MEMORANDUM OF AMENDED AND DEVELOPMENT AGREEMENT <br /> STATE OF TEXAS <br /> COUNTY OF CALDWELL § <br /> Notice is hereby given that the City of San Marcos,Texas, a Texas home-rule municipal <br /> I% <br /> corporation (the "City"), and Franklin Mountain San Marcos I, LP, a Texas limited <br /> partnership ("Franklin Mountain"), have entered into an Amended and Restated Development <br /> Agreement ("Development Agreement') with respect to certain property owned by Franklin <br /> Mountain. A copy of the Development Agreement has been recorded in the records of Caldwell <br /> L <br /> County under the filing number . A portion of the property included in the <br /> Development Agreement is within the boundaries of a municipal utility district, as more <br /> I. <br /> particularly described in the attached Exhibit "A" (the "MUD Property').
