Prohibition on Issuing Financial Assistance Awards to Entities that Require Certain Internal <br /> Confidentiality Agreements. <br /> The Subrecipient must not require their employees,subrecipients, or contractors seeking to report fraud, <br /> waste,or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting <br /> such employees, subrecipients, or contractors from lawfully reporting such waste,fraud, or abuse to a <br /> designated investigative or law enforcement representative of a federal department or agency authorized to <br /> receive such information. The Subrecipient must notify their employees,subrecipients,or contractors that <br /> existing internal confidentiality agreements covered by this condition are no longer in effect. <br /> 3.1.5. Publicity and Acknowledgement of Support—USDA Forest Service. <br /> The Subrecipient shall not publicize or otherwise circulate promotional material(such as advertisements, <br /> sales brochures,press releases, speeches,still and motion pictures,articles,manuscripts or other publications) <br /> which states or implies governmental,Departmental,bureau or government employee endorsement of a product, <br /> service,or position that the Subrecipient represents.No release of information relating to this award may state or <br /> imply that the Government approves of the Subrecipient's work products or considers the work product to be <br /> superior to other products or services. The SFI Recipient must obtain prior approval for any public information <br /> releases concerning this award which refer to the USDA Forest Service or any bureau or employee(by name or <br /> title). The specific text, layout of photographs,etc. of the proposed release must be submitted with the request for <br /> approval. The Subrecipient must include this provision in subawards made under this award to any recipient <br /> other than a State, local, or federally recognized Indian tribal government. <br /> 3.1.6. Deliverables/Products <br /> If deliverables/products other than standard financial and performance reports are produced <br /> under this award,the Subrecipient is required to send two printed copies of all final published products to: <br /> (a) through electronic mail to the SFI Project Manager Michael Martini (Primary)or Paul Johnson. <br /> 3.2 Department of Agriculture <br /> 3.2.1. Federal Financial Assistance. <br /> The Subrecipient is subject to the OMB guidance in subparts A through F of 2 CFR Part 200, as adopted and <br /> supplemented by the USDA in 2 CFR Part 400.Any subaward must follow the regulations found in 2 CFR 200.330 <br /> through .332 <br /> 3.2.2. Eligible Workers. <br /> The Subrecipient shall ensure that all employees complete the I-9 form to certify that they are eligible for lawful <br /> employment under the Immigration and Nationality Act(8 USC 1324a). The Subrecipient shall comply with <br /> regulations regarding certification and retention of the completed forms. These requirements also apply to any <br /> contract or supplemental instruments awarded under this award. <br /> 3.2.3. Nondiscrimination. <br /> 31 <br />
