RESOLUTION NO.2024-182R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS FINDING A USED ANIMAL SERVICES VEHICLE TO <br /> BE SURPLUS AND OF NO FURTHER VALUE TO THE CITY; <br /> AUTHORIZING THE CITY TO DONATE THE VEHICLE TO PETS <br /> PREVENT A LITTER OF CENTRAL TEXAS; FINDING THAT SUCH <br /> CONVEYANCE SERVES THE PUBLIC PURPOSE OF REDUCING <br /> OVERPOPULATION OF ANIMALS; AUTHORIZING THE CITY <br /> MANAGER, OR HER DESIGNEE, TO EXECUTE A DONATION <br /> AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City's Neighborhood Enhancement Department possesses a vehicle that has <br /> reached the end of its useful life for animal services purposes and is therefore declared surplus. <br /> 2. Pets Prevent a Litter of Central Texas is a tax-exempt non-profit organization whose <br /> mission it is to provide low cost spay/neuter, vaccinations, and microchipping to the community. <br /> 3. Pets Prevent a Litter of Central Texas provides vouchers that the animal shelter can <br /> provide to low-income families to have their pet spayed or neutered. <br /> 4. Pets Prevent a Litter of Central Texas also provides the community with services to <br /> support Trap-Neuter-Release of colony cats. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The City Council finds and determines that a vehicle, no longer in use by the <br /> City Neighborhood Enhancement Department, is surplus and of no value to the City of San <br /> Marcos. <br /> PART 2. The City is authorized to donate this vehicle to Pets Prevent a Litter of Central <br /> Texas. <br /> PART 3. The City Manager or her designee is authorized to execute the attached Used <br /> Equipment Donation Agreement and all other pertinent documents necessary to transfer title and <br /> convey the vehicle to Pets Prevent a Litter of Central Texas. <br /> PART 4. The vehicle is being donated on an "as-is" basis, with no guarantees whether <br /> express, implied or otherwise, as to its condition, performance, fitness for a particular purpose, <br /> title or merchantability and that all costs associated with pick-up, transport, refurbishing, <br />
