obligations under this Agreement. Operator may employ, on a full, part-time or
<br /> seasonal basis, such other additional personnel as may be reasonably necessary to
<br /> carry out its obligations hereunder; provided, however, that in the event the costs
<br /> of such additional personnel has not been provided in the applicable Annual
<br /> Operating Budget, employment of such additional personnel is subject to the
<br /> limitation that expenditures for this category in excess of the amount shown in the
<br /> Annual Operating Budget shall not be reimbursable to Operator. Operator shall set
<br /> policies commensurate with the objectives of the City (and use best efforts to
<br /> enforce such policies) regarding the conduct, demeanor, and appearance of its
<br /> employees (including policies which prohibit such employees or agents of the
<br /> Operator from soliciting or conducting business in a loud, noisy, boisterous,
<br /> offensive, or objectionable manner), who shall be trained and possess the
<br /> qualifications as may be required by all governmental authorities in carrying out
<br /> assigned duties. Operator shall perform background checks or require background
<br /> checks to be performed on all personnel assigned to the Airport by the Operator,
<br /> and the City shall have the right to review such background checks.
<br /> 3.1.17 Supervise and manage its employ The Operator will:
<br /> a. Be solely responsible for the performance of its employees. In addition, the
<br /> Operator will ensure that its employees provide airport customers with the
<br /> highest level of courtesy, efficiency, operational performance and
<br /> responsiveness.
<br /> b. Provide adequate training for its personnel in areas of operation, maintenance,
<br /> safety, supervisory skills, energy management, etc.
<br /> c. Be responsible for all costs associated with its employees including, but not
<br /> limited to, salaries,wages, overtime,pay differential, longevity,unemployment
<br /> compensation, holiday pay, meal allowance, education assistance, hospital,
<br /> medical, dental plans, life insurance, retirement contributions, sick leave and
<br /> other costs directly attributable to the Operator's employees. In addition, the
<br /> Operator will be fully responsible for processing payroll for its employees.
<br /> Financial Services. The Operator will:
<br /> 3.1.18 Promptly collect all funds due in connection with the management and operation of
<br /> the Airport (including but not limited to, lease payments, through the fence
<br /> agreement payments, tie down fees, license fees, concession fees, access fees,
<br /> landing fees,customs fees, signage fees,gross receipts taxes, and fuel flowage fees)
<br /> and deposit into the Operating Account, and remit on a monthly basis by the 25th
<br /> of the month, all such funds with the Finance Department during regular business
<br /> hours. Each remittance should provide an accurate and true accounting of all
<br /> revenue codes related to the collection of funds.
