RESOLUTION NO. 2024-23SR <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN AMENDMENT TO A WATER <br /> SHARING AGREEMENT WITH THE COUNTY LINE SPECIAL UTILITY <br /> DISTRICT TO ALLOW THE CITY TO RE-ACQUIRE SOME OF THE <br /> WATER RIGHTS AT ITS REQUEST AND WITH MUTUAL <br /> AGREEMENT; AUTHORIZING THE CITY MANAGER, OR HER <br /> DESIGNEE, TO EXECUTE THE AMENDED AGREEMENT ON BEHALF <br /> OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. In June of 2024,the City of San Marcos and the County Line Special Utility District <br /> entered a water sharing agreement under which the City of San Marcos temporarily assigned water <br /> rights to the County Line Special Utility District. <br /> 2. The City of San Marcos now anticipates the need for additional Edwards Aquifer <br /> Water for the City. <br /> 3. The County Line Special Utility District has supplies above and beyond their <br /> current needs and is willing to allow the City of San Marcos to re-acquire some of the water rights. <br /> 4. The two cities now wish to execute an Addendum / Amendment allowing for this <br /> transaction. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Addendum/Amendment with the County Line Special Utility <br /> District allowing the City of San Marcos to re-acquire some of the water rights at its request and <br /> with mutual agreement is approved. <br /> PART 2. The City Manager,or her designee,is authorized to execute said Addendum <br /> /Amendment on behalf of the City. <br /> PART 3. This resolution shall be in full force and effect immediately from and after <br /> its passage. <br /> ADOPTED on December 3, 2024. <br /> _'�Jane Hughson <br /> Mayor <br />
