RESOLUTION NO. 2024-237R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN AMENDMENT TO A WATER <br /> SHARING AGREEMENT WITH THE CITY OF KYLE TO ALLOW THE <br /> CITY OF SAN MARCOS TO RE-ACQUIRE SOME OF THE WATER <br /> RIGHTS AT ITS REQUEST AND WITH MUTUAL AGREEMENT; <br /> AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO <br /> EXECUTE THE AMENDED AGREEMENT ON BEHALF OF THE CITY; <br /> AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. In May of 2024,the City of San Marcos and the City of Kyle entered a water sharing <br /> agreement under which the City of San Marcos temporarily assigned water rights to the City of <br /> Kyle. <br /> 2. The City of San Marcos now anticipates the need for additional Edwards Aquifer <br /> Water for the City. <br /> 3. The City of Kyle has supplies above and beyond their current needs and is willing <br /> to allow the City of San Marcos to re-acquire some of the water rights. <br /> 4. The two cities now wish to execute an Addendum /Amendment allowing for this <br /> transaction. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Addendum /Amendment with the.City of Kyle allowing the <br /> City of San Marcos to re-acquire some of the water rights at its request and with mutual agreement <br /> is approved. <br /> PART 2. The City Manager,or her designee,is authorized to execute said Addendum <br /> /Amendment on behalf of the City. <br /> PART 3. This resolution shall be in full force and effect immediately from and after <br /> its passage. <br /> ADOPTED on December 3, 2024. <br /> Jane Hughson� <br /> Mayor <br />
