Buy America Preference Waivers Currently in Effect for HUD Programs <br /> Under Section 70914(b),HUD is able to issue, after consultation with OMB's MIAO, <br /> general waivers, and project-specific waivers to the BAP if it is determined that a waiver falls into <br /> one of the following three categories: 1)when applying the domestic content procurement <br /> preference would be inconsistent with the public interest,2)when types of iron, steel, manufactured <br /> product or construction materials are not produced in the United States in sufficient and reasonably <br /> available quantities or of a satisfactory quality, or 3)where the inclusion of those products and <br /> materials will increase the cost of the overall project by more than 25 percent. In order for HUD to <br /> consider either a general or project specific waiver request and be able to review it with OMB,the <br /> waiver must include a detailed written explanation and allow for the public to comment for at least <br /> 15 days, as required under Section 70914(c). <br /> 9 <br />
