<br />PROPOSED REVISION TO <br />CITY CHARTER SEC. 3.06 <br />VACANCIES <br /> <br />Note: Sec. 6.09, pertaining to filling vacancies which result from <br />recall elections, simply requires vacancies to be filled in accordance <br />with the general procedures for filling vacancies, which are contained <br />in Sec. 3.06. <br /> <br />NOW READS: <br /> <br />Sec. 3.06. <br /> <br />Vacancies. <br /> <br />A special election to fill a vacancy shall be called in <br />accordance with the Texas Election Code. No such election shall <br />be held sooner than thirty (30) days from the date it is called. <br /> <br />REVISE TO READ: <br /> <br />Sec. 3.06. <br /> <br />Vacancies. <br /> <br />(a) A special <br /> <br />election to <br /> <br />fill a <br /> <br />vacancy <br /> <br />shall be <br /> <br />called <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />Texas Election Cone. <br /> <br />In the event the <br /> <br />Hayor <br /> <br />is <br /> <br />unable <br /> <br />to order <br /> <br />the <br /> <br />election <br /> <br />for <br /> <br />any <br /> <br />reason, <br /> <br />the remaining members of the <br /> <br />city counci] are authorized and <br /> <br />directed <br /> <br />to <br /> <br />order <br /> <br />the <br /> <br />election <br /> <br />and <br /> <br />perform <br /> <br />all <br /> <br />other <br /> <br />required <br /> <br />actions incident <br /> <br />to <br /> <br />the election. <br /> <br />In <br /> <br />the <br /> <br />event <br /> <br />of <br /> <br />vacancies <br /> <br />in the offices of mayor and all members of the <br /> <br />city council for <br /> <br />any reason, <br /> <br />the <br /> <br />following <br /> <br />persons, <br /> <br />in <br /> <br />the <br /> <br />order <br /> <br />prescribed, <br /> <br />are authorized and directed to order <br /> <br />the election and perform all other required actions <br /> <br />incident <br /> <br />to the election: <br /> <br />(1) The city manager <br />( 2) The city secretary <br />( 3) The city attorney <br /> <br />( 4 ) <br /> <br />The <br /> <br />presiding <br /> <br />judge <br /> <br />of <br /> <br />the <br /> <br />municipal <br /> <br />court. <br /> <br />(b) No such election shall be held sooner than thirty <br /> <br />( 30) <br /> <br />days <br /> <br />from the date it is called. <br />
