Audits. <br /> Due the earlier of 30 days after receipt of the independent certified public accountant's <br /> report or nine months after the end of the fiscal year, Grantee shall submit one electronic <br /> copy of the single audit or program-specific audit to the System Agency via: <br /> i. HHS portal at hgps:Hhhsportal.hhs.state.tx.us/heartwebextr/hhscSau or, <br /> ii. Email to: single_audit_reportghhsc.state.tx.us. <br /> B. Financial Statements. <br /> Due no later than nine months after the Grantee's fiscal year-end, Grantees not required <br /> to submit an audit, shall submit one electronic copy of their financial statements via: <br /> i. HHS portal at https:Hhhsportal.hhs.state.tx.us/heartwebextr/hhscSau; or, <br /> ii. Email to: single audit reportLhhsc.state.tx.us. <br /> ARTICLE V. WARRANTY,AFFIRMATIONS,ASSURANCES AND CERTIFICATIONS <br /> 5.1 WARRANTY <br /> Grantee warrants that all work under this Grant Agreement shall be completed in a manner <br /> consistent with standards under the terms of this Grant Agreement, in the applicable trade, <br /> profession, or industry; shall conform to or exceed the specifications set forth in the Grant <br /> Agreement;and all deliverables shall be fit for ordinary use,of good quality, and with no <br /> material defects. If System Agency, in its sole discretion, determines Grantee has failed to <br /> complete work timely or to perform satisfactorily under conditions required by this Grant <br /> Agreement, the System Agency may require Grantee, at its sole expense, to: <br /> i. Repair or replace all defective or damaged work; <br /> ii. Refund any payment Grantee received from System Agency for all defective or <br /> damaged work and, in conjunction therewith, require Grantee to accept the return of <br /> such work; and, <br /> iii. Take necessary action to ensure that Grantee's future performance and work conform <br /> to the Grant Agreement requirements. <br /> 5.2 GENERAL AFFIRMATIONS <br /> Grantee certifies that, to the extent affirmations are incorporated into the Grant Agreement, <br /> the Grantee has reviewed the affirmations and that Grantee is in compliance with all <br /> requirements. <br /> 5.3 FEDERAL ASSURANCES <br /> Grantee further certifies that, to the extent federal assurances are incorporated into the Grant <br /> Agreement, the Grantee has reviewed the federal assurances and that Grantee is in <br /> compliance with all requirements. <br /> 5.4 FEDERAL CERTIFICATIONS <br /> Grantee further certifies that, to the extent federal certifications are incorporated into the <br /> Grant Agreement, the Grantee has reviewed the federal certifications and that Grantee is in <br /> compliance with all requirements.
