-5- Early Voting Ballot Board at City Hall in the City Secretary's Early Voting/Conference Room, 630 East Hopkins Street in the City in accordance with the Election Code. Early votes shall be counted at the central counting station. The Early Voting Ballot Board shall perform in accordance with applicable provisions of the Election Code. SECTION 15.That an electronic voting system, as the term is defined in the Texas Election Code, shall be utilized in connection with the election. This system shall be utilized for all early voting as well as for all precinct voting conducted on election day. Ramona Brown is appointed as programmer, and she shall prepare a program for the automatic tabulating equipment. Ample voting equipment shall be provided for early voting and in each of the various precincts on election day. The central counting station is established as the office of the City Attorney, San Marcos City Hall, 630 East Hopkins. SECTION.16.That the City Council of the City shall, by resolution, appoint the Early Voting Ballot Board, a Presiding Judge of the Central Counting Station, a Tabulation Supervisor of the Central Counting Station, and a Central Counting Station Manager, and any and all assistants appointed by the Presiding Judge and Tabulation Supervisor shall be subject to the approval of the City Council. SECTION 17. That the election shall be held under, and in accordance with the provisions of, the Charter and Ordinances of the City of San Marcos,`and in accordance with the laws of the State of Texas. SECTION 18.That an executed copy of this Ordinance shall serve as proper notice of the election. SECTION 19. That notice of the election including a Spanish translation thereof, shall be published at least once in a newspaper published in San Marcos on or after April i 3, 1997 and on or before April 23, 1997, and shall be posted on the bulletin board at City Hall on or before April 15, 1997. SECTION 20. That a copy of this Ordinance shall be delivered on or before March 24, 1997 to the presiding judge of each election precinct in which the election is ordered to be held, which copy shall serve as a notice or writ of election as required by the Texas Election Code. SECTION 20.1 A copy of the full text of the initiative ordinance described in Sections 1.1 and 1.2 of this ordinance will be kept available for public inspection at each City election precinct described in Section 4 of this ordinance and at each early voting polling place described in Section 12 of this ordinance. SECTION 21. That testing of the automatic tabulating equipment shall be performed and notice thereof shall be given in accordance with Subchapter D of Chapter 127 of the Texas Election Code. SECTION 22. That the rate of compensation to be paid judges, clerks, and assistants to the Central Counting Station Presiding Judge and Tabulation Supervisor for services rendered during the election is established at$6.00 per hour. SECTION 23. That the additional compensation to be paid judges who deliver returns of the election is established at$25.00. 4 SECTION 24. That if any portion of this Ordinance is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect. SECTION 25. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
