<br />15 <br /> <br /> <br />REGULAR MEETING MAY 14, 19qn PAGE 2 <br /> <br /> <br />Mayor Morris opened the Public Hearing and asked if anyone wished <br />to speak for or against the provision of the Resolution. Mr. Tommy <br />Bodine asked about the Resolution. Mark Taylor, City Attorney, <br />addressed the issue and gave a brief explanation. Mary Martinez, <br />Director of Planning and Development Services explained that Land Use <br />Assumptions are used as a basis relation for fee assessments. <br />Mayor Morris closed the public hearing. Mr. Moore moved for adoption <br />of the Resolution and Mr. Hart seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Morris introduced for consideration the appeal of Manuel Ramirez <br />from the decision of the Zoning Commission made April 3, 1990 to deny a <br />specific use permit for on-premise consumption of Beer and Wine at 71l <br />Bugg Lane. Mayor Morris opened the Public Hearing and asked if anyone <br />wished to speak. Mr. Moore asked why this appeal had not been sent to <br />ZBOA. Ms. Martinez stated this was a special exception because of the <br />Specific Use Permit and the appeal was to the Council. Mr. Ruben <br />Garza spoked on behalf of Mr. Ramirez and informed the Council <br />that Mr. Ramire,z feels he is being treated unfairly because several <br />establishments near him have a Specific Use Permit which allows <br />consumption of alcohol on the premises. Mr. Ramirez is willing to <br />make several of the concessions that are being required by the <br />Planning Commission. Ms. Martinez stated that the Zoning Commission <br />had also taken into consideration that Mr. Ramirez was not selling <br />any food. Mayor Morris asked whether Mr. Ramirez could do his own <br />site plan or hire someone to it. Mr. Garza stated that he would <br />recommend to Mr. Ramirez to hire someone to do the site plan so that <br />he could get the exact measurements and then the City could verify <br />the parking requirements. Ms. Martinez stated that as soon as Mr. <br />Ramirez brought in his site plan the staff would then verify it. <br />Mayor Morris closed the public hearing. Mr. Hernandez moved that the <br />appeal be tabled for the 29th agenda pending information Mr. <br />Hart seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1989-1990 <br />FISCAL YEAR (ORDINANCE 1989-38) TO PROVIDE FUNDING FOR THE <br />THORPE LANE RECONSTRUCTION PROJECT AND FOR OVERTIME PAY FOR <br />FIRE DEPARTMENT EMPLOYEES; AND DECLARING AN EMERGENCY. <br /> <br /> <br />Mr. Hart moved for adoption of the Ordinance on emergency and Mr. <br />Moore seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />Aye: Moore, Hernandez, Hart, Morris, Kissler, Plummer <br /> <br />Nay: None <br /> <br />Abstain: Guerra <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE MINIMUM STANDARDS FOR AIRPORT FIXED BASE <br />OPERATORS AND TENANTS TO DECREASE THE REQUIRED PASSENGER <br />LIABILITY INSURANCE LEVEL; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br />PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Plummer seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of the minutes of <br />the Regular Meeting of April 23, 1990 and the Special Meeting of <br />May 7, 1990, approval of three ordinances on second reading, adoption <br />of four ordinances on third reading and adoption of six resolutions, <br />
