RESOLUTION 2009 - 168R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE SUBMISSION OF A GRANT <br />APPLICATION TO THE TEXAS DEPARTMENT OF <br />TRANSPORTATION FOR A STATEWIDE TRANSPORTATION <br />ENHANCEMENT PROGRAM GRANT TO CONSTRUCT AN ADA <br />COMPLIANT CROSS-TOWN PATHWAY-BICYCLE AND PEDESTRIAN <br />TRANSPORTATION CORRIDOR; CERTIFYING FUNDING AND <br />SUPPORT FOR THIS GRANT; AUTHORIZING THE CITY MANAGER <br />TO ACT ON THE CITY'S BEHALF WITH REGARD TO THE <br />SUBMISSION OF THIS GRANT APPLICATION AND THE EXECUTION <br />OF ALL CONTRACTS AND AGREEMENTS WITH THE TEXAS <br />DEPARTMENT OF TRANSPORTATION AS NECESSARY FOR THE <br />IMPLEMENTATION OF THESE IMPROVEMENTS AND DECLARING <br />AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City wishes to improve the safety and efficiency of movement of pedestrians <br />and bicyclists through the construction of an ADA compliant Cross-Town Pathway-Bicycle and <br />Pedestrian Transportation Corridor (the "Project"). <br />• 2. The Texas Department of Transportation ("TxDOT") has grant funding available <br />through the Texas Enhancement ("TE") Program. <br />3. The City wishes to submit a grant to TxDOT for consideration of this available <br />grant funding. <br />RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The submission of a grant application to TxDOT for TE grant funding for <br />construction of the Project which will assist in accomplishing surface transportation goals of the <br />City and its surface transportation partners is approved. <br />PART 2. The City agrees to commit to the Project's development, implementation, <br />construction, maintenance, management and financing. <br />PART 3. The City certifies its provision of 30 percent of the total Project cost in <br />local matching funds. <br />PART 4. The City Manager, Rick Menchaca, is authorized to act on the City's <br />behalf with regard to the submission of the grant application and the execution of a grant contract <br />1
