• ORDINANCE NO. 2009-70 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "C" COMMERCIAL TO "HDR" <br />HIGH DENSITY RESIDENTIAL FOR AN 8.188 ACRE, MORE OR <br />LESS, TRACT OF LAND LOCATED AT 1311 NORTH I-35; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "GC" GENERAL COMMERCIAL <br />DISTRICT TO "MF-24" MULTPLE-FAMILY RESIDENTIAL <br />DISTRICT; AND INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On October 27, 2009, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "C" Commercial to "HDR" High Density Residential, and a <br />concurrent request to change the zoning from "GC" General Commercial District to "MF-24" <br />Multiple-Family Residential District, for an 8.188 acre, more or less, tract of land located 1311 <br />North I-35. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />. considered and voted to approve the requests on October 27, 2009, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on November 17, 2009 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "C" <br />Commercial to "HDR" High Density Residential: <br />Street address: 1311 North I-35 <br />Size: 8.188 acres, more or less <br />0
