• removed within the area proposed for development shall be designated on <br />an application for a Site Preparation Permit or a Watershed Protection <br />Plan, Phase 2 (see Chapter 1, Article 7). An aerial photograph indicating <br />the tree canopy shall be submitted with an application for a Watershed <br />Protection Plan, Phase 1, together with a designation of the location of <br />specimen trees in the area proposed for development. Removal of any <br />such trees without City approval is expressly prohibited. Such trees shall <br />be tagged and numbered, and numbers shall be graphically depicted on the <br />applicable plan submitted. The tags and related numbers shall remain on <br />the trees until the Certificate of Occupancy is issued. <br />SECTION 20. Section 5.5.2.2, Tree Protection Standards - Residential and <br />Nonresidential Development, caption and subsection (a), are hereby amended to read as follows: <br />Section 5.5.2.2 Tree Protection Standards - <br />DevelopmeM <br />(a) Application. The provisions of this Section apply to all new fesidential ° <br />°sidefAia development within the City. <br />SECTION 21. Section 6.1.1.5. General Requirements, subsection (e), is hereby <br />amended to read as follows: <br />0 (e) Removal of Diseased or Dangerous Trees and Vegetation. <br />(1) Upon direction from the Director of Public Wer-ks Services a property <br />owner may be required to treat or remove trees suffering from <br />transmittable diseases or pests or allow the City to do so, charging the <br />actual cost thereof to the property owner. <br />(2) The Director of Public WerlES Services may require the removal of a tree <br />or part of a tree or any other vegetation that is within or overhanging a <br />public right-of-way or easement if the tree or vegetation: <br />a. Is diseased or infested and in danger of falling; <br />b. Is creating a traffic hazard or sight distance hazard for traffic on a <br />public street; or <br />c. Is interfering with safe and proper maintenance of the right-of-way <br />or easement. <br />SECTION 22. Chapter 6, Article 1, Division 3, Fencing, is hereby amended to read as <br />follows: <br />is
