a. Staff will identify that a landmark's structure's or building's condition falls <br />under the criteria of Demolition by Neglect. This initial identification may <br />originate from a staff inspection of the neighborhood or by citizen referral. <br />b. The staff shall present it's findings and recommendations to the Historic <br />Preservation Commission at a public hearing with a report detailing the <br />defects which, in the staffs opinion, indicate Demolition by Neglect. The <br />owner is notified by certified mail of the hearing. The Historic Preservation <br />Commission must render a decision within 45 days of the date notice of the <br />public hearing is provided to the owner, as to any finding of Demolition by <br />Neglect subject to any supplemental options under subsection (2)d . <br />c. If a findina of Demolition by Neglect is made by the Historic Preservation <br />Commission without any recommendation to exercise any options under <br />subsection 2(d), staff shall proceed under the process outlined in the building <br />ordinance to require correction of defects or repairs so that such structure shall <br />be preserved and protected in accordance with the pumoses of this chanter and <br />applicable building ordinances. <br />d. If the Historic Preservation Commission renders a decision finding Demolition by <br />Neglect, it may request that the City Council authorize negotiations with the owner <br />for the acquisition by gift, purchase, exchange or otherwise of the property or any <br />• interest therein or for the making of a grant or loan to the owner to prevent further <br />deterioration in furtherance of the purposes of this division and Article 5, division 5 <br />of Chapter 1 of the Land Development Code. If a determination is made by the <br />Historic Preservation Commission under this subsection, neither the owner or the <br />city may demolish, the historic landmark or subject building structure or feature for <br />180 days after the date of notice to the owner of the public hearing under <br />subsection (2) b, except upon a finding of an imminent threat to public safety by the <br />Chief Building Official under applicable ordinances. Upon a finding of an imminent <br />threat to public safety by the Chief Building Official, whether or not notice to the <br />owner and a hearing would be required prior to demolition, the Chief Building <br />Official shall provide notice to the Director of Planning before proceeding with any <br />demolition. <br />Section 5.1.1.3 Runoff Attenuation <br />(a) Techniques to Minimize Erosion. Under this Chapter, all drainage channels on the site <br />shall be designed to minimize potential erosion. In addition to standards in Section <br />5.1.1.2, the following runoff attenuation strategies and techniques shall be used: <br />(1) All constructed and altered drainage channels shall be stabilized and vegetated <br />immediately after final grading. <br />(2) Effective energy dissipation techniques must be used at inlets to and outlets from <br />ponds. Inlets to ponds must also have sediment traps, with a wall or gabions, <br />• designed to trap the bulk of sediments and facilitate sediment removal. <br />(3) Velocity checks must be made on channel slopes over 2%.
