No. 2006-45, § 47, 9-19-06) <br />Section 6.1.3.2 3 Fences in Nonresidential and Multi-Family Areas <br />(a) Fences Permitted Adjacent to a Street, Park or Trail. <br />(1) Materials permitted. Fence or walls may be constructed of wood, decorative <br />metal, masonry, or other decorative materials. Chain link, <br />woven wire mesh metal panel, or similar materials are not considered decorative <br />fencing, and are therefore not allowed for this purpose except for property in <br />Industrial and Heavy Commercial districts. Those properties may utilize chain link <br />fencing along a street if additional landscape material is provided between the <br />fence and property line to assure compatibility with properties along that subject <br />street. <br />• (2) Location of fencing. No fencing shall be placed between the property line and the <br />building setbackline when adjacent to a public or private street right-of-way, park <br />or trail. <br />(3) Height of fences. Any fence or wall located between the street right-of-way and <br />the front facade (or side facade if a corner lot) of a building shall not exceed three <br />feet in height unless one of the following conditions applies: <br />A. The fence is less than eight feet tall and is on property in an Industrial or <br />Heavy Commercial zoning district. <br />B. The fence is less than eight feet tall, decorative and encloses only <br />outdoor dining or recreation areas. <br />(4) Fences between buildings on the same lot. Any fence located facing a street that <br />is between adjacent buildings and behind the front most facade of either building <br />may not exceed eight feet in height. <br />(b) Fences Permitted Along Private Property Lines. <br />(1) Materials permitted. Generally fences or walls may be constructed of wood, <br />decorative metal, masonry, chain link or other similar materials.
