• ORDINANCE NO. 2009-74 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 55, MUNICIPAL COURT, <br />SECTION 55.04, POWERS AND DUTIES OF MUNICIPAL COURT <br />JUDGE, BY ACKNOWLEDGING THE POWER OF THE MUNICIPAL <br />COURT JUDGE TO CONDUCT WEDDING CEREMONIES AND <br />ESTABLISHING A FEE THEREFOR; PROVIDING A SAVINGS <br />CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING <br />PROVISIONS; AND PROVIDING AN EFFECTIVE DATE <br />RECITALS: <br />1. Pursuant to an amendment to Section 2.202 (a) of the Texas Family Code, <br />municipal court judges were granted the authority to conduct wedding ceremonies <br />effective September 1, 2009. <br />2. It is necessary to establish a uniform fee to be charged for wedding <br />ceremonies performed by the municipal court judge of the City of San Marcos during <br />normal business hours of the municipal court while on the premises of the City. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />so MARCOS, TEXAS: <br />SECTION 1. Chapter 55, Municipal Court Judge, Section 55.04, Powers and <br />Duties of Municipal Judges, is hereby amended to read as follows: (underlining indicates <br />added text and strikethroughs indicate deleted text): <br />Sec. 55.04 Powers and duties of municipal judges. <br />(a) If more than one division of the municipal court of record is created, the <br />judge of each division may at any time exchange benches and sit and act for each other in <br />any pending case, matter, or proceeding. <br />(b) The presiding judge may assign an associate municipal judge to act for the <br />presiding judge who is temporarily unable to act for any reason. An associate municipal <br />judge has all the powers and duties of the office while acting for the presiding judge. <br />(c) The presiding judge and associate municipal judges shall: <br />(l) Hold court within the city at a place designated by the city council; <br />(2) Follow all rules of procedure contained in the city ordinances and state <br />law; <br />0
