ORDINANCE NO. 2009-76 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE CITY'S 2009-2010 <br />BUDGET TO AMEND THE PERSONNEL ROSTER FOR THE <br />SAN MARCOS FIRE DEPARTMENT; AND DECLARING AN <br />EMERGENCY. <br />RECITALS: <br />In accordance with Section 8.16 of the City Charter, the City Council declares that a <br />public necessity exists that requires an amendment to the City's 2009-2010 Budget. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Personnel Roster for the San Marcos Fire Department that is part of <br />City Budget Ordinance for the 2009-2010 Fiscal Year is amended by replacing the existing <br />staffing table with the staffing table that is attached hereto as Exhibit "A." <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />• SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4. The importance of this Ordinance creates an emergency and an imperative <br />public necessity, and the provisions of the Charter requiring that ordinances be presented at two <br />separate meetings be waived and, this Ordinance will take effect thirty days after the adoption of <br />the Meet and Confer Agreement between the City and the San Marcos Professional Fire Fighters <br />Association. <br />PASSED, APPROVED AND ADOPTED on the 1St of December 2009. <br />Susan Narvaiz <br />Mayor <br />Attest: Approve: <br />l r " " L <br />• Sherry Mas urn Michael .Cosentino <br />City Clerk City Attorney
